Robert Mihail is a patent attorney with more than two decades of intellectual property experience spanning patent prosecution and litigation, trademarks, copyrights, technology transfer, and IP portfolio monetization across a broad range of industries and jurisdictions. He brings particular depth at the intersection of intellectual property and federal procurement law.

Prior to joining Effectus, Robert was an attorney with the U.S. Army, where his practice included intellectual property and federal acquisition matters. He currently serves as a Judge Advocate (Major) in the U.S. Army Reserves.

Robert has drafted and negotiated R&D agreements and monetized patent portfolios spanning electronics, automotive, defense, oil and gas, renewable energy, food manufacturing, and life sciences. He has advised a major R&D organization on indirect infringement exposure, declaratory judgments, and reexamination strategy, and has guided multinational clients through cross-border transactions, anti-counterfeiting programs, and copyright chain-of-title matters.

 His government contracts IP work has centered on the FAR/DFARS technical data framework, unlimited, government purpose, and limited rights regimes, and on sustainment-phase disputes involving technical data access demands and depot-level maintenance conflicts.

Robert has litigated before the Patent Trial and Appeal Board and the U.S. Court of Appeals for the Federal Circuit in matters involving complex technologies, including implantable medical devices and pharmaceuticals. His patent prosecution experience covers software and pharmaceuticals.

His practice at Effectus covers the full IP lifecycle: utility and provisional patent filing and prosecution (including software and AI-related inventions), Patent Trial and Appeal Board proceedings, freedom-to-operate and patentability analysis, trademark filing and prosecution, Trademark Trial and Appeal Board proceedings, copyright registration and DMCA enforcement, and IP licensing with particular focus on FAR/DFARS data rights and Bayh-Dole compliance.
